Unfortunately, the portrait one is wrong both times so it isn't the skin 'rotating' them — As far as software (and the camera) is concerned they're landscape pictures with a "show this in portrait mode" flag attached.
Pretty much all display devices are wider than they are taller in their 'normal' orientation, so the files are likely to match that, with the camera adding the "rotate me" flag.
I think it's probably the global attachment routines not reading the orienation from the metadata.
I don't know whether this is by design or omission, but I do know that attachments don't have any such metadata stored in the database.
This probably isn't something I'm going to fix, but a workaround could be to use the Gallery which provides a rotation function. [ETA: And the Gallery probably reads the metadata, so it may well it get it right anyway.]

One way to think about it is like old-school negatives and prints — If you take a portrait shot on film, it's sideways on the negative and is printed in landscape just like all the other frames — You have to pysically rotate the print to get it the right way up for viewing.

your welcome missy, glad you learned what you needed to know, thats all way above my head tho is there a way to upload to the gallery on the new skin? i'm not seeing it

Another (easier?) option might be to rotate the pictures on your phone somehow instead.

It's not in the menu at the top because it's probably horribly messy (it wasn't a part of the new skin so it inherits lots of stuff from the old one).
